ER Solutions Collection Agency Information

by Donald Petersen on June 12, 2011

ER Solutions, Inc. is a collection agency. ER Solutions apparently calls from the following telephone numbers :

(800) 846-2460 or 800-847-2460

(800) 847-2461 or 800-847-2461

(877) 317-1200 or 877-317-1200

(888) 559-0021 or 888-559-0021

According to the collection agency’s website, consumers wishing to call ERS about an account should call :

(800) 444-8485 or 800-444-8485.

ER Solutions is a Washington corporation which was known as International Mercantile Company, Inc. until it changed its name on July 17, 2000.

ER Solutions is licensed to collect consumer debts in the State of Florida. To the best of my knowledge, ER Solutions does not file any collection lawsuits in Florida.

ER Solutions’ website is :

http://www.convergentusa.com/ERS/index.php

I almost always recommend that consumers always use certified mail (return receipt requested to communicate with collection agencies) and recommend that consumers never use e-mails or on-line dispute processes (why invite evidentiary issues).

I provide information concerning collection agencies to assist consumers in their on-line search for information. When I do so, I am not stating or implying anything about how the collection agency collects debts.

According to the company’s Annual Report filed with the Florida Secretary of State, ER Solutions’ principal offices are located at :

800 SW 39th Street
Renton, WA 98055

ERS’s mailing address is :

P.O. Box 9004
Renton, WA 98057

ER Solutions does not sue consumers in Florida. ER Solutions is not licensed to collect consumer debts in Florida. ER Solutions, Inc. has registered as a foreign corporation with the Florida Secretary of State in order to do business in Florida. ER Solutions may be able to call you but they don’t file lawsuits in Florida. I have not seen any indication that ER Solutions ever files suit in any other states either.

Like most third party collection agencies, ER Solutions seldom, if ever, reports account information to the credit reporting agencies. (The entity that assigned the account to ER Solutions for collections may do so however.)

Consumers who have additional telephone incoming telephone numbers that they believe are used by ER Solutions are encouraged to share these telephone numbers by commenting. We will attempt to verify the numbers and add them to our list.

If ER Solutions is calling you (or calling other people about you), you may contact me by completing the Collection Agency Harassment Form in the right hand column of this page.

If you are a Florida resident, you are also welcome to call my assistant. I will contact you to discuss your situation and how I may be able to help you.

If you live outside Florida and you complete the Collection Harassment form, I will try (as a courtesy to you) to provide you with the name and contact information or other resources so that you can contact an experienced FDCPA lawyer who is licensed to practice law in your state.

For information about lawsuits that consumers have filed against ER Solutions, Inc. alleging that the agency violated the Fair Debt Collection Practices Act, click on the hyper-link.

Consumers who ER Solutions attempted to collect a debt from are welcome to publicly comment about their experiences with ER Solutions by commenting.

I have also received calls daily from 425-562-3215. When you call this number back or the
1 – 800-444-8485 number back it ALWAYS goes to the answering machine. An automated system responds every single time with… “Your call is being answered by Audic (Audit?). You can not leave a message because the mailbox is full.” I can not understand if they are saying Audic, Audit, or something similar.

They also appear to be operating as WCI Financial. I originally received a letter from them as ER Solutions regarding a Sprint bill. I sent a letter of dispute. I checked my credit report and noticed that ER Solutions closed their account and on the very next day WCI appeared on my report as a negative report. I googled WCI and found that they are in fact ER Solutions. I called one of the many numbers that supposedly belong to WCI and I got a recording saying that I have reached ER Solutions. If I read the FDCPA correctly, it would seem that they are in violation by continuing to send negative reports to the reporting agencies and have made no attempt to verify that they are able to collect this debt (as my dispute letter stipulates) or proof that I owe the amount they claim (also as my dispute letter stipulates). Maybe this is thier way to get around the FDCPA and FCRA by reporting my disputed debt under another company name. This hardly seems ethical or legal. I am in the process of sending another letter to them advise them to cease and desist, since they are in fact the same company and their continued negative reporting is a clear violation of the FCRA.

I keep getting phone calls from E R Solutions and the phone number is (425) 562-3215.I live in **** and they’ve called about seven or eight times in the last hour or so. It’s probably about a Sprint cell phone bill from many years that my parents took care of for me because I was out of state. The account was closed and they kept calling. I don’t even answer because my time is valuable and they are just wasting time by calling me even one time.even if it was a legitimate debt I couldn’t pay anything anyway because I don’t have a job and have more important things I need money for. They might as well just keep calling because i won’t answer. How much is a credit report and how do I get one ?

Reply

Don Petersen August 8, 2011 at 5:21 PM

A Guy : You can obtain a free credit report because you are unemployed or use your right to obtain the free credit reports that you can request once a year (every 365 days). Do not rely on resellers, etc. To obtain the reports directly from the credit reporting agencies’ cooperative website go to Triple W DOT AnnualCreditReports DOT Com. I highly recommend that you order the reports by phone. The internet versions omit important details that likely contain information that you (or your lawyer) will need.

So i called all of the numbers listed above…most of them say you have reached a telemarketing number…but i did however get someone on the phone with the (888) #’s…the guy apparently claims that my number that they are harassing is not in their system and is not sure why i am getting calls from them. then when i told him that it doesnt make sense why i am getting calls from them when its not in their system he gave a ‘tude…WTF…so i requested to be put on their do not call list and the guy continued giving me an attitude so i hung up on him…

Dani : Debt collectors often use numbers that “go dead” when someone attempts to call the number back. The list of numbers I’ve provided was compiled from lawsuits against ER Solutions so it should be reasonably accurate. The collectors routinely equip ALL of their telephone numbers with a feature that “captures” the incoming number for further calls. I hope this information helps.

I do not owe any money to any one that should be in collection should have went on my bankruptcy. But some other collection companies are selling old settled bills and bills that were filed and the companies that are buying them are trying to collect them watch out this is an illegal practice but they are getting away with it somehow. So stop calling ER Solutions

ER Solutions have been calling my house 5 times a day for the last three months. Someone who has the last name as I apparently owes them money. I called the number and requested they take my number off assuring them I was not the women they were looking for and owed them nothing. I am tired of clearing my voice mail ten times a day and listening to their stupid message, and its stupid, believe me. Now they are calling seven times a day.

Nico – Thanks for sharing your experience and your opinions. I am not aware that anyone is impersonating ER Solutions. It is possible that foreign or domestic scammers could decide to impersonate a legitimate U.S. debt collector (e.g., ER Solutions). I published your comment because of your warning to consumers to be skeptical of collection calls especially if : (1) the consumer does not receive letters; (2) the collector demands immediate payment by Western Union, electronic checking, etc.; and/or (3) the debt collector is attempting to “match up” the alleged account with the consumer. Consumers should send debt validation letters via certified mail / return receipt requested.

Since receiving a paper invoice – I have been receiving calls from them for months. They allege it is for an amount owed to Verizon which is beyond the statute of limitations. Interesting that it is in the middle of the time I lived at that address. I sold the house and I have checks for payments made. Makes no sense I would owe something for middle of that period.
I found a template I got online and will send a letter certified asking them to terminate collection efforts on this alleged debt.
A year or two ago I had a similar problem with another collection company – also an alleged debt to Verizon from an 11yr prior address. I contacted the state attorney general. Though the company could not provide me with proof of the debt – they came up with something for the attorney general – and offered a minimal payoff. I did not pay it. I believe they are capable of fabricating “proof”.
I get calls from 610-400-1378 Brit accent and the 425-562-3215.
They do ask the last 4 of your SS# – and I bit. Older and wiser.

I recieved a call from ER Solutions 425-562-3215. They knew my name and a address i previously lived at 3 yrs ago. They wanted me to verify my information and before I would verify any information I asked why they were calling and for what company. They would not answer me and instead told me not to raise my voice at them and that they do not tolerate it. I told her that I had yet to raise my voice to her and that I would not give out any information unless she informed me what it was regarding. After going back and forth for a few seconds she finally hung up on me. I am posting this to tell people to not let them intimidate you. Make sure it is a legitimate call and that they know your information without you giving it to them. Just because they know your name and a previous address doesn’t mean a thing.

Just got a call from a “Kelly Smith” from phone number 817-717-3844, along with a lengthy voice mail stating that simply by listening to it I was acknowledging that I was someone they were looking for. Love hearing that, like they have any way to verify who actually listens to their stupid messages. Apparently they now think if they make someone sound exotic or European that people will listen to their voice mails and call them back….NOT!!!

Yes Ms M, it seems that ER Solutions has gotten smarter and are now spoofing their number to a local number, so that you think it may be someone you know. Then she wanted my social security number and I told he “no way” because I have spent the last seven years getting my identity back due thanks to the VA losing their computer to theft. I get tired of the calls but the lady gave me the address they had and I let her have the last four and she said that is not the address or the social and we will remove you. It wasn’t me.

I have the same issue a “Kelly Smith” called my phone from a (214)705-2138 number (the funny thing is the caller id showed the name as Strightout Med) saying I owe money. The number they told me to call was (800) 989-2807 so I called it. It took me to a voicemail of onix or whatever but they said his Ext number was 8999 then directed me to another line then the called end which is odd. At first I thought it was from a loan I did back in July but I have bank statement saying I paid it off so tomorrow morning I will be contacting them to see why they are calling me its odd to me that the company is from WA or FL but I’m from Texas. I would love to hear what they have to say and why I owe money. I will get their information and report them.

I have not answered any of these calls after looking them up on line and seeing what they are; they all appear to be coming from the same organization. I do not have any outstanding debt, have lived in the same home for many years and have not received any mail saying that I owe anything, and my cell phone number is only known to my immediate family. These calls are really annoying. I am not sure how to get them to stop. I am not going to give this organization any personal information.

She then wanted me to start providing personal info which I told her I would not give her any info until she told me what it was about. All she would tell me was it was about Direct Merchants Bank which I never heard of. I told her this and again she started trying to get info from me which I refused and then she hung up.

Grumpy : There are at least several services that debt collectors appear subscribe to. These services obtain the information a variety of ways. If one of a consumer’s creditors reports a cell phone number to the credit bureaus, the credit bureau will associate the number with the consumer and include it in the “Credit Header” information. Even if a consumer does not provide the cell phone number to any creditors, merchants have been known to sell the cell phone information. Several years ago, Papa John’s Pizza was accused of selling names, cell phone numbers, and addresses. I doubt P.J.’s was the only company doing this. For information about whether debt collectors may call your cell phone, and the industry’s efforts to deprive consumers of laws protecting them from cell phone calls, read these articles : http://www.fdcpa.me/topics/cell-phone/

I called back again and finally got a person who said he was JOE WOOD. He told me that they were a collection agency and asked for my name. I said my first name and then he tried to get my last name out of me by saying he didnt want to “mispronounce” it. I told him to spell it (I didn’t want to give him anymore info) and he spelled my last name, which was correct. He then asked for my last 4 digits of my SS#. I refused and he accused me of being uncooperative and said when “You want to cooperate call back”. I told him he knew I was the person he said he wanted to talk to but he insisted that he didn’t know that, even though, after he brought up a bill that I do have, he said the name of the company… I told him the amount… he still said he didn’t know it was me and insisted on me giving him my last 4 numbers of my SS#. I told him how I looked ERS up on the internet and know that people have been complaining about this company, etc. and said he was full of crap and hung up on him!!

Butch :

Collection agencies can not arbitrarily (or greedily) add collection fees. Whether a collection agency can add any collection fee depends upon : (1) state law; and (2) the language in the contract which may allow the creditor (or assignee) to recover some or all of its “costs of collection”. I recommend that you consult with an experienced FDCPA lawyer who is licensed to practice in your state.

The FDCPA does not generally prohibit debt collectors from calling on Sundays. Please refer to this article : http://www.fdcpa.me/when-where-can-collectors-call/

Yeah one of them called me today from ER Solutions 800-759-9854. It was a lady’s voice and she never told be her name, but they did call me at WORK!!! my direct dial to say the least and it leads me to wondering HOW THE HECK! did they get my work number? Anywho, she kept asking me who i was and i asked her to spell the name because she was saying it wrong (my name is african and very unique). Anywho, i asked her where she was calling from, who she was and why she was calling and she started arguing with me that she wasnt going to tell me anything untill i confirmed if i was the correct person and i told her, i need to know what this call is for and what you want and she started going off on me and threatened to hang up she was like ” are you the persons name i just spelled or what? How can you expect me to tell you who i am and what i want if you cannot confirm if you are the person i need to speak with? You know what lady, just forget it, okay, i dont have time to sit her and go back and forth with you on who i am and why am i calling so i am about to hang up on you, i dont have time for this mess!” As soon as i heard her say that, i hung up on her first! booyah!! I dont even know what it was for and i was going to tell them not to call me at work, and hod did they get my work number, but since the lady was so mean and nasty, i decided to just hang up on the rep.

I did however call the number back from my cell and got their voice message….

Desi & Other Guests : The Fair Debt Collection Practices Act *generally* prohibits debt collectors from disclosing that they are attempting to collect a debt, that the consumer allegedly owes a past due account or even the name of their company to anyone other than the consumer or the consumer’s spouse. Debt collectors can call third parties (persons other than the consumer or the consumer’s spouse) to obtain “location information”. Please refer to : http://www.fdcpa.me/collection-agency-calling-family/
The debt collector should identify the name of their employer but only once asked or in when leaving a phone message or letter to the consumer. Please refer to this article : http://www.fdcpa.me/collection-agency-message-wh/ The debt collector shoul have identified their company but was prohibited from venturing further unless they confirmed that it was the consumer who they were speaking with.

They just called **** Their new number they are operating with is 877-844-1567. ER Solutions came up on my caller ID. They wanted to collect on a debt that had been paid off over 20 years ago. Person on the phone would not give their name or agent number then hung up after I stopped them mid rant to ask for it.

They just called from 866-377-9075. An automated voice told me to “don’t hang up, please hold for an important phone call, the next available representative will be with me shortly”. They have been harassing my husband on his work cell. All our records are in storage but we are pretty sure we don’t owe this. We just purchased a vehicle and since the credit report went through we’ve been getting these “out of the woodwork” calls.

I have got many calls from this company for a debt that I am currently paying off . When I told them that I was paying this debt they got mad. and basically told me I am not … I had also asked them to send me all documents on this debt( about a month ago..) and still have not got anything from them.

*** Here in Colorado, they use a program that targets individuals using their home state area codes (eg., ASPEN with a 970 prefix). When you answer, or call back, the program will provide your name, collection information on a company claim (eg., T-Mobile). After contacting T-Mobile (Bellevue, WA) they indicated no “collection notification” was ever given prior to any final billing. They further indicated no one gave ER Solutions (aka as Convergent Outsourcing, Renton, WA) any direction or information about the account or any past due. *** ER Solutions/Convergent may have some explaining to do.

Got a call for several days now from 800-759-9854. Haven’t answered it yet. From what I see on a search it is E. R. Solutions.

The last debt collector called me 3 times a day for months.

Do not ever pay a debt that is beyond the statue of limitations. Each state is different I believe but here in Michigan it is 6 years. DO NOT agree to anything as far as making payment arrangements. It is recorded and can be used as an acceptance to the debt and they can harass you into paying up. Legally there is nothing they can do to you. Just try and intimidate you into paying.

I had one called Afni trying to collect a 15 year old debt. I found an attorney online who sued them after I sent them a cease and desist letter and they still called. Once they get that letter they are not supposed to call you again. I got a small settlement but it was worth it. Called payback.

Don Petersen June 9, 2012 at 7:32 AM

Shipdog – Thanks for the info. about ER Solutions. It is a matter of state law whether a promise to pay would revive a time barred debt. Under Florida law, a promise to pay would have to be “written”. Hmmm… I would agree with you that it’d be a bad idea to promise to pay a time barred debt. (Duh.) But, if someone verbally promised to pay a time barred debt, they should consult with a consumer lawyer in their state before they assume that any verbal promise revived the SOL as you confidently assert. Thanks for bringing the issue up.

So my daughter kept getting calls that she owed money on a Lane Bryant acct. She used to have one but paid it off, shows paid on her free credit report. They kept trying to get her to give them her social security number to “verify” her identity. She refused and they never called back. I think it’s a scam

Reply

Don Petersen July 27, 2012 at 8:49 AM

ER Solutions is a large collection agency. The accounts get transferred around so much and the data bases are probably not integrated. It’s probably a mistake rather than a “scam”. I doubt the collection agency reported the account to a credit reporting agency, but they may have. It’s usually a good idea to check the credit report to verify that the account is not being reported when the account was previously paid off.

Got a call and voicemail from Convergence 855-343-7885, they said they were trying to collect a debt from a jewelry store that I don’t remember having an acct. at ( if I did, it was paid for and forgotten about years ago)… When I called back and told the “lady” I didn’t recall an acct. she got pissy and said she’d put a dispute in her computer for further investigation… This is obviously a scam as my credit report is clear, I bought a truck last year, a car 3 months ago, and a house 2 months ago… I hope that if they have called you and that if you are reading this that you haven’t paid!!!

Reply

Don Petersen August 16, 2012 at 9:42 AM

J. – While I agree with much of what you’ve shared, I would not call this call a “scam”. Mistakes happen. If you had a jewelry store acct. but it’s over 7.5 years since you paid anything, the account would be obsolte and should no longer appear on your credit report. Debt collectors can still call (and write) attempting to collect it but they can not threaten to sue or exercise remedies that they could only get by obtaining a judgment. Your comments serve as an excellent reminder why consumers should be skeptical of debt collector’s claims and request validation before they pay. Thanks for sharing your experience so people know to become informed.

I have been getting calls under the name of ER Solutions, phone number 1-800-759-9854. I have not answered these calls, as I did not know what ER Solutions was (of course, no message was left either). Anything that they might call me about is over 6 years old (which is the statute of limitations in my state), so it must be the zombie debt companies again. I have been bullied by another company recently, and I’m not about to let that happen again!

I get calls using my formerly married name, and I have not used that name in almost 6 years – I am not that person anymore and I HATE when they call using that name!

M.W. It would assist people who read this blog if you could be more specific by stating whether the account was yours and the type of information ER Solutions was requesting. Often, debt collectors seem to be engaged in “fishing trips”. But, people who conceal their whereabouts by falsely claiming not to be the person the collector is calling may risk having the statute of limitations tolled. Since very few debt collectors sue and even those select few rarely file suit, the statute of limtations is often the consumer’s biggest ally.

I have been getting a lot calls from 206-777-1957 and my caller ID says that the name was unavailable. I have been getting a lot of robocalls wanting someone that doesn’t live here and that we do not even know, so I let our answering machine screen all of our calls now. ER and Convergent does sound familiar because they are the ones that call for these total strangers. Just now I had the number 206-777-1957 call and it showed a different name all together. Only thing that was left on the machine was a robocall that said “2″.

Something has got to be done about this. I have tried everything, blocking numbers, screening, telling them that these people do not live here and to stop calling, ect. I have even reported one or two to the FTC. I am getting fed up. Much more so because we are expecting some very important calls and here are these idiots tying up the lines harassing us.

Lisa – Government agencies typically wait until they receive lot of complaints against the same debt collection company. This can take quite a while. The most effective way for consumers such as yourself to obtain relief is to consult with a FDCPA lawyer who practices law in their state and, once the case is ripe, file a FDCPA lawsuit. Filing the lawsuit almost always stops the calls from not only the defendant debt collector but most other debt collectors as well. (Debt collectors do not want to call consumers who they know are represented by a consumer rights lawyer.) I gladly provide contact information for experienced FDCPA lawyers in other states to visitors who complete the Collection Harassment Form in the right hand column of this page. Good luck.

Been getting calls for the past 2 weeks (about 3-6 per day) from 402-817-0691, 402-875-6099, 402-817-0783, 402-965-0049 and finally 402-403-3192.

I finally answered today and it was some “lady” claiming there was an important legal matter she had to discuss, but needed to verify who I was. She asked for my ss#, I refused…she then said I could give her the last 4 only. I still refused. This “lady” then said she was trying to help me if only I would stop interrupting her…had to laugh at that one!!

Anyhow…I let her know I would verify my name…if she was able to provide it to me first. She did say my first and last name (pronounced wrong…btw)…She also gave a partial address after I verified my name. …I confirmed she had the name right so I questioned who she was and why she was calling…did not ask for my social again.

She did say at that time she was calling from ER Solutions in regards to an alleged debt I owe to Wells Fargo, and numerous letters had been sent to the address on file in which I never responded…really? I have not received any “letters” from ER Solutions was my response…

Apparently (according to her) I owe a debt to Wells Fargo in the amount of $105.00 for overdraft charges incurred in Aug. 2009. I explained I did not have a Wells Fargo acct, nor had any checking/savings acct for at least 5 or 6 years…and the last bank I banked with was not Wells Fargo. This “lady” then questioned if I had a Wacovia acct, and that Wells Fargo had bought the company. NOPE. She then said I needed to talk to some other person to make a recorded statement denying the acct was mine, and placed me on hold. Well…considering I was at work…I hung up.

They have not called back…I attempted to call after work, but the recorded message said all representatives were busy and to hold…of course no one picked up.

What are my options at this point? I want the calls to stop…I do not owe Wells Fargo or any other bank for that matter. I actually had my credit checked about 3 or so weeks ago (when I had to replace my car)…ER Solutions, Wells Fargo nor Wacovia were listed as a collection acct. , and I got the car with nary a problem.

Ugh…so frustrated.

Here is a new number that they call from: 503-820-0990. They keep calling my cell phone and when I answer I recieve an automated voice, which no matter who it is, I usually hang up on. This time I listened to the whole thing. After a few seconds it told me the number I was trying to reach was busy and for me to leave a message. I used Google to reverse look-up the phone number and it is listed as a cell phone based out of Portland, Oregon. Let’s be clear-just because it’s based out of Portland doesn’t mean they are calling from Portland. I have no idea who they are or what they want. However I haev recieved calls from creditors in the past when I was doing a credit “clean-up” and these calls do not reflect the proffesionalism of a ethical collector.

Sandy – I receive a LOT of complaints similar to yours. I recommend that you contact a consumer rights lawyer who is licensed to practice law in your state. I would also begin documenting any conversations (including the date & time of each conversation) where you tell the collection agency that they’re calling someone you don’t even know. Even then, the calls often continue despite several conversations. Suing under the FDCPA usually stops the calls!

I told them that I would resolve the matter later on in the month due to lack of money at the time. I called Century Link to confirm the truth. Then four days later the same number (877-317-0948) called me back harrassing me for payment. I reminded them that they called four days ago and that I would resolve the matter before the end of the month. They were rude and very unprofessional. Then the lady on the phone had the nerve to call me a lier and said that they called eight days ago. I told the lady I would be taking care of the issue through Century Link and not them and then hung up. I then proceeded to call my cell phone company and blocked their number from my phone. This company should be reported for poor business managment with its customers.
